Terms of Service

These Terms of Service govern access to and use of MappedPulse, a software service operated by Brook Marketing Solutions (“MappedPulse,” “we,” “us,” or “our”). By accessing or using the service, you agree to these terms on behalf of yourself and, where applicable, the business you represent.
Using MappedPulse
You may use MappedPulse only for lawful business purposes and only if you have authority to act for the applicable business or workspace. You are responsible for your users, account credentials, submitted information, configuration choices, and activity performed through your account.
Connected services
MappedPulse may connect with third-party platforms such as construction-management systems, communications providers, calendars, website platforms, and business-profile services. Your use of those services remains governed by their separate terms and policies. Features may change or become unavailable when a provider changes its APIs, permissions, policies, pricing, or availability.
Customer communications
You are responsible for the content, recipients, timing, and legal basis of communications sent through MappedPulse. You must obtain and document all consent required by applicable law and industry rules, honor opt-out requests, and avoid deceptive, unlawful, abusive, or unwanted messages. Approval by a communications provider does not replace these responsibilities.
Business Profile and review features
You may connect or manage only profiles you own or are authorized to manage. Review responses, listing changes, and other actions must be specifically authorized and comply with the applicable platform’s policies. MappedPulse does not guarantee publication, ranking, review removal, search position, or continued API access.
Your content
You retain ownership of content you submit. You grant MappedPulse a limited license to host, process, transmit, display, and create technical copies of that content as necessary to provide, secure, and improve the service. You represent that you have the rights and permissions necessary to provide the content and authorize this processing.
Acceptable use
You may not use MappedPulse to violate law or third-party rights; send spam or prohibited content; misrepresent identity or authorization; gain unauthorized access; interfere with security or operation; reverse engineer the service except where law expressly permits it; or use the service to build or train a competing product without written permission.
Availability and changes
MappedPulse is under active development. Features may be introduced, changed, limited, or discontinued. We may perform maintenance or suspend access when reasonably necessary for security, compliance, provider requirements, or protection of the service. We do not promise uninterrupted or error-free availability.
Fees
Paid plans, usage allowances, registration charges, and additional fees will be disclosed in an order, subscription, or onboarding agreement. Unless that agreement states otherwise, fees are non-refundable once incurred, particularly third-party registration, telephone-number, messaging, and compliance charges.
Termination
You may stop using MappedPulse and request disconnection of your workspace. We may suspend or terminate access for material breach, unlawful or risky activity, nonpayment, provider enforcement, or threats to the service. Provisions that by their nature should survive termination—including payment, ownership, disclaimers, and limitations—will survive.
Disclaimers
To the maximum extent permitted by law, MappedPulse is provided on an “as is” and “as available” basis. We disclaim implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and warranties arising from course of dealing. MappedPulse does not provide legal, tax, telecommunications-compliance, or professional construction advice.
Limitation of liability
To the maximum extent permitted by law, MappedPulse and Brook Marketing Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from use of the service. Any aggregate liability will be limited to the amount paid for MappedPulse during the twelve months preceding the event giving rise to the claim, unless applicable law requires otherwise.
